I’m often asked about points being added to a record after a person is restored from a suspension. Often the court, nor the attorney know that there will be an assessment of 5 points. This is proper for PennDOT to asses these points. This gives them the opportunity to monitor you closely, and if more points assessed….re-suspend your license out of concern that you may not be safe on the road. PA Vehicle Code § 1545 gives them the authority to asses these points.

§ 1545. Restoration of operating privilege.

Upon the restoration of any person’s operating privilege which has been suspended or revoked pursuant to this subchapter or pursuant to Chapter 38 (relating to driving after imbibing alcohol or utilizing drugs), such person’s record shall show five points, except that any additional points assessed against the person since the date of the last violation resulting in the suspension or revocation shall be added to such five points unless the person has served an additional period of suspension or revocation pursuant to section 1544(a) (relating to additional period of revocation or suspension). This section shall not apply to section 1533 (relating to suspension of operating privilege for failure to respond to citation) or to 18 Pa.C.S. § 6310.4 (relating to restriction of operating privileges).

These points will fall off of the record at a rate of 3 points per year of no new violations. If you do get stopped within that one-year period, and you are convicted of a violation that adds suspension or points, you will not lose those three points until you do complete one year with no convictions.
