Failure to Maintain Financial Responsibility Where Vehicle was Involved in Accident Reported to Police Under 75-3746, 75-1785

§ 1785. Proof of financial responsibility following accident.

Fine $25, plus $300 for violation of 75-1786(f)

Additional penalty: 3 month revocation of vehicle registration, per Pa. Code 67-§219.7(b)

– No conviction if proof of financial responsibility is produced at office of issuing authority within 5 days of violation, per Title 75 – §1786(g)(1)

Suspension of 3 months, per Pa. Code 67-§219.7(a)

 

§ 1785. Proof of financial responsibility following accident.
If the department determines that the owner of a motor vehicle involved in an accident requiring notice to a police department pursuant to section 3746 (relating to immediate notice of accident to police department) did not maintain financial responsibility on the motor vehicle at the time of the accident, the department shall suspend the operating privilege of the owner, where applicable, and the department shall revoke the registration of the vehicle.

§ 219.7. Suspension of operating privilege or revocation of vehicle
registration.

(a) Operating privilege suspension. Failure to show proof of financial responsibility as required by 75 Pa.C.S. § § 1784 and 1785 (relating to proof of financial responsibility following violation and proof of financial responsibility following accident) will result in a 3 month suspension of the vehicle owner’s operating privilege if the owner was driving at the time of the traffic offense or accident.

(b) Vehicle registration revocation. Failure to show proof of financial responsibility as required by 75 Pa.C.S. § § 1784 and 1785 will result in a 3 month revocation of the registration of the vehicle for which the required financial responsibility was not in effect at the time of the traffic offense or accident.
